Noise: grinding and whining. When: anytime driving over 15 mph. Front right tire turning slight right noise quiets or goes away. Driving straight sounds horrible. Turning left slightly sound worse. I took the tire off the router and break bracket. Put it in drive with just that tire and everything off located the noise at the cv axel where it inserts into what I been told is the transmission. I hear the noise in the driver seat more than I do with my head in the wheel well. Need to know where to start at. Don't have much money to replace each thing one at a time.

It sounds as if your problem is in the differential, problem is it is part of the transmission and very specialist equipment and knowledge is required to do any major repairs in this area, I would get a mechanic to listen to this noise and confirm the diagnosis, if this is the case the cheapest option would probably be a second hand transmission.

Is there any test that I could do to find out if it's the cv or the differential.

You will have to remove and dismantle the cv to see if there is any damage, as for the trans oil, the diff is combined with the trans and the oil level is checked with a plug on the side of the trans, there is a red filler plug on top of the transmission, fill the trans till oil starts to dribble from the side level plug.
