During acceleration the car falls out at 3500 or 3800 rpm. Even if I was to put the gas pedal to the floor it will not red line it drops off at 3500 rpm. Someone tried to tell me there is a governor on this vehicle. I am thinking TPS. What is your opinion? And would a new TPS fix this problem?

Live data scan will show what percentage the TPS is at 100% will be full throttle. If you can get a scan done and a live data read this will be a big help with any diagnosis.

The rpm governor only kicks in in Park and Neutral so when you have the scanner hooked up, verify that the transmission range selector is reporting the gear position correctly.
