2003 Hyundai Tiburon cracked piston .. small cases court ca

300 miles after having the timing belt replaced, the engine froze. The repair shop will not take any responsibility. I took the car to a Hyundai dealer and they are willing to write a statement that piston #5 is cracked and that is all. They are not good at formulating a forensic analysis thus we have to do the thinking for them and they will gather and write up factual evidence.

Since it is not possible to prove beyond reasonable doubt that the timing belt was installed improperly, I need to present at least that this is the most likely cause over all other possible causes.

What I need from you is:
1. Credentials of expertise on this Hyundai model/year.
2. What else could cause a piston to crack besides a timing issue: eg: broken valve spring; broken spark plug; any other?
3. Any experiences related to faulty installation os timing belts.
4. BIG question: looking at the 2 pictures - taken on March 13 and June 19. The first shows the belt 8 teeth off and the second one timing is on center. I need an explanation why the belt moved. Both are real credible photos.
