do you need to drain the transmission before replacing the drive axle?

Nope. When you set the car on jack stands, set it so the side you are working on is an inch or two higher than the other side. That will reduce the amount of fluid that spills out. You will not lose much, but if the car is level, it could be as much as two quarts.
