when i first start up i cant put it in gear because it just starts to roll with the engine start, also its really hard to switch between gears. This happens even more so when its cold. Is this the wrong transmission fluid or do i need a new clutch?

Does the trans shift smoothly when the engine is off? If so, chances are the pressure plate is going bad.

As far as the trans fluid, what do you have in it and when was the last service?
