what would cause soot around the muffler and can it be driven like that

Is it around the muffler or the tail pipe?

Soot is a normal byproduct of the combustion process. If the soot is excessive, it would be from over fueling.(rich air/fuel mixture)

Is it around a small pinhole at the front or back of the muffler?
