1993 BMW 318 Oil change

I took my husbands car for an oil change and the next day it started to smoke and sputter. it was even difficult to start. After you drive it for 15 miles or so it will stop but, then if it has to sit again it will do it again. I took it back to the place that changed the oil and they said that it had 1/4 quart over the amount it should. I believe it was more than than it look like more than a quart to me. Even after taking the excessive oil out it is still sputter, smoking (black smoke) and difficult to start. Can this have done more damage than what they are willling to admit?

Oh absolutely it could have. I would get a second opinion and possibly involve the bureau of automotive repairs if push comes to shove. Or go back and get them to make it right.
