Do you need to pump out the oil from the engine before removing it from the motor?

Recently my motor in my mercedes benz c class broke because apparently there was no oil in it. The local mercedes mechanics are blaming this on me, however a while ago I slightly crashed the same car, and the motor had the be removed and repaired. My question is whether the mechanics needed to pump out the oil before removing the motor? because if yes, then its 100% their fault. PLEASE answer ASAP
