My 2009 Kia Spectra spits and sputors only after I fill it up with gas. once the gas hand moves down a little it stops?

There is no check engine light on. What is the evap system and can it b fixed at home or by a shop?

EVAP system is Evaporative Emission Control system and incorporates many components, some elevctrial, others vacuum or fuel hoses.
It is not easy to repair without any trouble codes as you need to check through the whole system and even a shop might not be able to rectify the problem and would be costly to go through all the components.

Yes, you should. The vehicle should still be under warranty and they would have to take care of that.
