2005 Mini Cooper Dificulty Engaging 1st 3rd Gear Down Gearbox Will Engage Little

dificulty engaging 1st and 3rd gear going up and down the gearbox but will engage a little easier if the revs are right; is the gearbox on its way out or is it a problem with the clutch. will go into 1st from 4th when going down the box and 5th from 2nd when going up the box. Please advise.

have you changed the fluid regularly??? it needs to be serviced as this is a big part of shifting feelings
