Hand brake is not staying up

The pawl in the hand brake is faulty, this is the lever that locks the hand brake up it may be a broken spring is the release button stuck in?

Thank you for this, but this handbrake mechanism is not the same as mine, Hyundai Getz 1.4i 2007. The button on the handbrake pushes a pawl which reaches into a gap in the lever assy, to apply pressure to the button, but I see nothing to engage with the ratchet detents that are cut into the handle, (only two as far as I can see). I was expecting to find a spring of some sort, but nothing can be found.
The plastic handle covering the metal frame, came loose this morning as I applied the brake, I think it should be glued in place, would anyone believe this happened as I was waiting in line for the yearly MOT, I was next to be attended, !!!!
