The break lights stay on when the car is running if the lights are on or if they are off do you think it is the break light switch? It will still let me put the car in gear so I am not sure if the switch is bad or not

The park release solenoid is actuated by power from the brake light switch. Since you can shift it, chances are the switch is either out of adjustment or bad.
