brake lights are always on even with ignition off/also tail lights do not come on at all

Brake lights are not controlled by the ignition switch on most cars. You need to inspect the brake light switch for proper operation. It's quite common for a rubber bumper that the switch plunger rests against to fall off so the switch isn't landing on anything to activate it.
