First thing is the clutch needs to be diagnosed as why it failed before possible blame can be placed.
Let me relate a story. We had a van in the shop for inspection that was in such poor shape that in not only failed but was not worth repairing. Not too often do I ever say that. So I get into the van to back it out, Pulled down on the shifter and I feel something pop. (Appearantly something inside the column had broke.) I just happened to be the guy that was the next one in line. IF the owner did it or Obama himself did it, it would have happened. My fault? I don't think so.
It turned into a fiasco and we lost in court.
What I am confused on yours is, you say clutch, but list it as an automatic transmission.
If it is a manual, that would have a clutch, then it should go well beyond 75,000 miles.
I would stay away from chains like sears.
